We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in these Terms (including our Privacy Policy, Shipping Policy, and Return & Refund Policy), describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using any part of the Services (including placing an order), you agree to be bound by these Terms and our policies.

If you do not agree to these Terms, you must not access or use the Services.

1) ELIGIBILITY, ACCESS AND ACCOUNT

You must be at least the age of majority in your place of residence to use the Services and place orders. If you are under the age of majority, you may only use the Services with permission from a parent or guardian.

To use the Services (including placing an order), you may be asked to provide information such as your email address, billing details, payment details, shipping address, and phone number. You confirm that the information you provide is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must not transfer or share your account with any other person.

2) OUR PRODUCTS AND PRODUCT INFORMATION

A. Product information and images

We take reasonable steps to display products accurately. However:

  • product colours and appearance may vary depending on your device/screen settings, and

  • packaging may change from time to time.

B. Ingredients and suitability

Skincare and personal care products may not be suitable for everyone. If you have sensitive skin, allergies, or are pregnant/breastfeeding or under medical care, you should check the ingredient list and consider consulting a qualified health professional before use.

Always patch test where appropriate and discontinue use if irritation occurs. Seek medical advice if you experience a severe reaction.

C. No medical advice

Information on our website (including routine suggestions, ingredient explanations and general skincare information) is provided for general informational purposes only and is not medical advice and is not intended to diagnose, treat, cure or prevent any disease.

D. Availability

All product descriptions, pricing, and availability are subject to change without notice. We may limit quantities per customer, household, or order.

3) ORDERS, ORDER ACCEPTANCE AND CANCELLATIONS

A. Order acceptance

When you place an order, you are making an offer to purchase. We may accept or decline your order (for example, due to stock availability, address verification issues, payment authorisation, suspected fraud, or system errors).

An order is only accepted once we send an order confirmation/acceptance email and payment has been successfully processed.

B. Cancellations and changes

If you need to cancel or change an order, contact us as soon as possible. Because orders may be sent promptly to fulfilment, we may not be able to cancel or amend an order once it has been processed or dispatched.

If we cannot cancel or amend your order, you may still have options under our Return & Refund Policy.

C. Personal use only

Products sold on the Services are intended for personal or household use only. You must not purchase for commercial resale or export without our written permission.

4) PRICES, TAXES AND PAYMENT

A. Currency

All prices are displayed in AUD unless stated otherwise.

B. Pricing changes and errors

Prices, promotions and availability may change at any time without notice. If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel the order (even after you receive an order confirmation) and refund any amount paid.

C. Taxes and duties

Where applicable, taxes and charges are handled as described at checkout. If any customs duties, import taxes, or carrier fees apply, you are responsible for paying them unless we state otherwise.

D. Payment

Payments are processed through Shopify Payments, PayPal, and other payment methods made available at checkout. You agree to provide current, complete and accurate purchase and payment information.

If your payment is declined or reversed, we may cancel your order.

5) SHIPPING AND DELIVERY

We currently ship to Australia only. Shipping fees, estimated delivery timeframes and delivery terms are described in our Shipping Policy.

Delivery timeframes are estimates only and may vary due to factors such as carrier delays, peak periods, weather events, or other circumstances outside our reasonable control.

Risk and delivery issues:
Risk of loss passes to you upon delivery to your nominated address (or as otherwise required by law). If your parcel is missing, delivered to the wrong address, or arrives damaged, contact us promptly so we can investigate with the carrier and/or fulfilment partner and assist you in line with our policies and applicable consumer rights.

6) RETURNS AND REFUNDS

Returns and refunds are handled in accordance with our Return & Refund Policy.

Nothing in these Terms is intended to limit your rights under the Australian Consumer Law (ACL).

7) PROMOTIONS, DISCOUNTS AND FREE GIFTS

We may offer discount codes, promotions, free gifts, bundles or limited-time offers. Unless stated otherwise:

  • promotions cannot be applied retrospectively,

  • discount codes may be subject to conditions (e.g., minimum spend, expiry dates, exclusions), and

  • free gifts are available while stocks last.

If you return items from an order that included a free gift or bundle discount, we may adjust the refund amount to reflect the promotion conditions, except where doing so would conflict with your rights under ACL.

8) CUSTOMER REVIEWS AND FEEDBACK

If you submit reviews, feedback, photos or other content (“Feedback”), you confirm that:

  • your Feedback is accurate to the best of your knowledge,

  • you own the rights to the content or have permission to share it, and

  • your Feedback does not infringe any third-party rights or contain unlawful, offensive, or misleading content.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display your Feedback for the purposes of operating, improving and promoting our Services (for example, displaying reviews on our website or social channels). We may moderate or remove Feedback at our discretion.

9) INTELLECTUAL PROPERTY

All content on the Services (including text, images, graphics, logos, product page design, layout and branding) is owned by or licensed to MEFORM.LAB and is protected under Australian and international intellectual property laws.

  • submit false or misleading information,

  • harass, abuse, defame, threaten or violate the rights of others, or

  • use the Services in a way that could damage our business, our customers, or the Services.

We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms.

11) THIRD-PARTY SERVICES AND LINKS

The Services may include links to third-party websites or services. We are not responsible for the content, accuracy, privacy practices or policies of third parties. Your use of third-party services is at your own risk.

12) RELATIONSHIP WITH SHOPIFY

Meform.Lab is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Meform.Lab. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Meform.Lab, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Meform.Lab.

13) PRIVACY

Because our store is hosted on Shopify, Shopify may also process certain personal information in order to provide and improve the platform.

14) AUSTRALIAN CONSUMER LAW (ACL)

Our goods come with consumer guarantees that apply under the Australian Consumer Law.

Nothing in these Terms (including any disclaimers or limitation of liability) is intended to exclude, restrict or modify any rights or remedies you may have under ACL that cannot be excluded.

15) DISCLAIMER OF WARRANTIES

To the extent permitted by law, the Services (including website content and features) are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • the Services will always be uninterrupted, timely, secure or error-free, or

  • information on the Services will always be complete, current or free from errors.

This section does not affect any consumer guarantees that cannot be excluded under ACL.

16) LIMITATION OF LIABILITY

To the extent permitted by law, MEFORM.LAB is not liable for any indirect, incidental, special or consequential loss (such as loss of profits, loss of revenue, or loss of opportunity) arising from your use of the Services or products.

Where the ACL applies and permits limitation for a failure that is not a major failure, our liability may (at our option) be limited to one or more of the following:

  • replacing the goods,

  • repairing the goods,

  • supplying equivalent goods, or

  • refunding the amount paid.

Nothing in these Terms limits liability where it cannot legally be limited, including under the ACL.

17) INDEMNITY

You agree to indemnify MEFORM.LAB (and our service providers, including Shopify, where applicable) against losses, liabilities and expenses arising from your breach of these Terms, misuse of the Services, or violation of any law or third-party rights.

18) TERMINATION

We may suspend or terminate access to the Services at any time if we reasonably believe you have breached these Terms or misused the Services.

Termination does not affect any rights or obligations that, by their nature, should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity).

19) CHANGES TO THESE TERMS

We may update these Terms from time to time for operational, legal or regulatory reasons. The updated Terms will be posted on our website with the revised “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

20) GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
